If errors are found in applying the rules, the deemed employer may need to pay the correct Income Tax and National Insurance Contributions. HMRC is considering allowing set-off of taxes already paid by workers against a deemed employer's PAYE liability. Assumptions and best judgment will be used to estimate taxes paid on off-payroll income. Workers and intermediaries can appeal direction notices within 30 days.
