Since April 2021 in the private sector (and 2017 in the public sector), the organisation engaging the contractor is responsible for determining status and issuing a status determination statement, provided it counts as medium or large. Small companies are exempt, and there the contractor's own company remains responsible. This is general commentary rather than advice; the detail depends on your circumstances and should be confirmed with a qualified adviser.

The off-payroll rules that moved responsibility to the client apply to medium and large organisations. If your business meets the small company definition, the responsibility for assessing status stays with the contractor's own limited company, as it did before 2021. The thresholds and the definition can change, so check your position with an adviser rather than assuming.
